Amazing Aerial — Contributor Terms of Service

These Terms of Service (“Terms”) govern your participation as a contributor on the Amazing Aerial platform.

Amazing Aerial is operated by We’re Those j.d.o.o., Splitska ulica 4, 52100 Pula, Croatia (OIB: HR86845673899) (hereinafter referred to as “Amazing Aerial”, “we”, “us”, or “our”).

By registering as a contributor and accepting these Terms, you (“the Photographer”, “you”, or “your”) agree to be bound by the following conditions.

1. Overview

These Terms define the relationship between you and Amazing Aerial for the worldwide distribution and licensing of your aerial photo and video content.

2. Distribution

Amazing Aerial acts as the exclusive distributor of all content you submit to the platform.

Your content may be distributed through:

● Partner agencies

● Media buyers

● Production companies

● Direct clients

3. Exclusivity

To maintain the commercial value of your content:

● You may not upload the same content to microstock platforms (e.g., Shutterstock, Adobe Stock, etc.).

● You may promote your work on your personal website and social media.

● You may license content directly to your own clients. We request that you inform Amazing Aerial of such sales to support usage tracking and infringement protection.

4. Copyright

You retain full copyright ownership of all submitted content.

Nothing in these Terms transfers copyright ownership to Amazing Aerial.

5. Infringement Revenue

Amazing Aerial may monitor and pursue unauthorized use of your content.

Any revenue generated from infringement claims will be shared as follows:

● 50% to the Photographer

● 50% to Amazing Aerial

6. Responsibility

You are solely responsible for ensuring that your content:

● Complies with all applicable laws

● Adheres to aviation and drone regulations

Amazing Aerial assumes no liability for legal claims, fines, or regulatory issues related to your content.

7. Promotion

Amazing Aerial may promote your content and portfolio through:

● Social media

● PR and marketing campaigns

● Industry events

● Advertising and publications

No royalties are payable for promotional use.

8. Revenue Sharing

Licensing Revenue (Ambassador Photographers)

In consideration of joining without a €1,500 onboarding fee:

● 40% to the Photographer

● 60% to Amazing Aerial

Performance-Based Increase

You may qualify for an increased royalty rate up to 50%, based on:

● 500 assets uploaded (+5%)

● $500 in sales (+5%)

Assignments & Commissioned Work

Assignments are agreed separately.

If a client relationship originates through Amazing Aerial, all related future work must be invoiced through Amazing Aerial.

9. Royalty Payments

● Royalties are payable once Amazing Aerial receives payment from the client.

● Sales activity is visible in your dashboard.

● Payouts can be requested once your balance exceeds $100 USD.

10. Invoicing

● Invoices will be generated by Amazing Aerial and provided prior to payout.

● Payments are made via PayPal.

● Transaction fees are your responsibility.

11. Term and Content Commitment

● These Terms apply for a minimum period of one (1) year.

● The agreement renews automatically unless terminated with three (3) months’ notice.

Content Availability

● Uploaded content must remain available for three (3) years from upload.

● If you cancel after one year, Amazing Aerial may continue licensing your content during this period.

● You will continue to receive royalties during this time.

● After three years, content may be removed upon request.

Subscription Plans

If you are on a paid subscription plan:

● Minimum commitment is one year of payments

12. Confidentiality

You agree not to disclose:

● The terms of this agreement

● Any confidential business information

Without prior written consent from Amazing Aerial.

13. Jurisdiction

These Terms are governed by the laws of the Republic of Croatia.

Any disputes shall be resolved under the jurisdiction of the courts in Pula, Croatia.

14. Updates to These Terms

Amazing Aerial may update these Terms from time to time.

● Minor updates may take effect immediately upon publication.

● Material or significant changes will be communicated to contributors in advance, allowing time for review.

Continued use of the platform after updates constitutes acceptance of the revised Terms.

15. Acceptance

By registering and submitting content to Amazing Aerial, you confirm that:

● You have read and understood these Terms

● You agree to be bound by them
